You may apply to the court for Guardianship of an adult for Property and/or Personal Care where the individual is incapable of making decisions pertaining to the management of their personal care and/or property. The proposed Guardian(s) must make an application to the Ontario Superior Court of Justice requesting that the court appoint them as the incapable person’s guardian of property and/or personal care. Property refers to a person's real estate, bank accounts, investments and all other financial means. Personal care decisions are related to a person's health care, shelter, safety, nutrition, clothing and hygiene.
The process for bringing a guardianship application for an alleged incapable adult persons and the duties of a guardian are set out in the Substitute Decisions Act, 1992. To apply, you must complete the proper forms, including an affidavit, management plan and guardianship plan. It is also helpful to include recent medical assessments as part of your materials.
In this package, we will meet with you and assess your case. Based on our discussion, we will draft your materials, serve it on the necessary parties and appear in court to argue the matter before a Judge.
